Introduction

Q: At what point are federal agencies allowed to destroy their records?

A: When the National Archives & Records Administration gives them permission.

From the standpoints of transparency, accountability, and history, the process of deciding when agencies can pulp their documents is fundamental, yet it receives little public oversight or attention. The process is kept as obscure as possible while still adhering to the letter of the law.

This webpage is an effort to make that process more transparent and prominent. I will be posting every agency’s proposal for records destruction/retention along with the National Archives’ response (“appraisal”). These documents are never posted by the Archives or by any agency. They must be requested, which is what I’m doing.

The National Archives (NARA) issues government-wide records retention schedules for broad types of documents, but when agencies want schedules for specific types of documents, they send a proposal (called a “request”) to NARA. This proposal describes the category of documents (which could be FBI surveillance recordings, passenger complaints to TSA, OSHA investigations of worker deaths, Superfund cost documentation at EPA, etc.) and what the agency would like to do with them. A small percentage of documents is proposed for permanent retention at the National Archives, but agencies typically want to destroy the vast majority of their documents after a certain amount of time.

A staff member at NARA’s Records Management Services division then appraises each request/proposal. Overwhelmingly often, the appraiser gives the green light to the agency’s proposal. (Sometimes NARA requests that the agency modify its proposal, and an agreement is reached, with NARA then approving the proposal.)

But this initial approval is tentative. The process is then opened up to public comment, though apparently few comments are received. Then, almost always, NARA grants final approval, with the Archivist of the United States signing off on the destruction/retention schedule. (More information about the process is here and here.)

But here’s what makes it so tricky. Once or twice a month in the Federal Register, NARA announces the proposals that it received from agencies, when the appraisals are ready or almost ready. You then must write to NARA and ask to be sent the proposals/appraisals you want. NARA does not post these crucial documents, even though it easily could. They’re PDFs, usually a few pages long. The public could simply go to a dedicated page (much like the one you’re on now) on NARA’s extensive website, look at what proposals have been received, then click on the PDF link for any one of them, as well as the corresponding appraisal. But no.

You must request a proposal/appraisal from NARA within 30 days of its announcement in the Federal Register. Then, once you receive it, a second clock starts ticking: You have 30 days to make a comment. What happens if you request a proposal/appraisal more than 30 days after it’s announced? Based on my experience, you’ll still be sent the documents, but you won’t be allowed to comment on them.

Once the comment period has ended for everyone who received a given proposal/appraisal, things get really murky. There’s no way to instantly check on the status of a proposal. If at some point it shows up in NARA’s collection of finalized Record Control Schedules (as well as the Recently Approved and Updated Schedules page), then you know it was given final approval. If you don’t see it there, you can’t look up where it is in the process. You have to contact Records Management Services at NARA to ask them what’s happening with a given proposal.

Who’s Covered?

This process casts an extremely wide net, applying to most of the federal government: Cabinet-level departments, independent agencies, intelligence agencies, the military, federal law enforcement, most of the White House, the federal court system (except for the Supreme Court), and several agencies in the Legislative Branch (including the Library of Congress and the Congressional Budget Office).

Also, NARA houses a lot of documents from agencies that no longer exist, such as the Office of the Housing Expediter and the Foreign Economic Administration. Sometimes NARA itself proposes destroying some of these documents.

What I’d Like to See

In order to make this fundamental process more open, I believe NARA should establish a page on its site containing a summary of each proposal, along with full PDFs of the proposal and the appraisal. The summary should clearly state the deadline for public comments. (Once the deadline is passed, the line would change to: “Comments on this proposal are now closed.”)

All comments received for each proposal should be posted with that proposal.

Each summary would then show the status of the proposal. When and if it’s given final approval, a PDF of the schedule would be posted (or a link would take you to the agency’s page of Record Control Schedules, like this one for the Drug Enforcement Administration).

Commenting

For each proposal I post here, I tell you the deadline I was given for making comments. According to Margaret Hawkins, who is in charge of this process at NARA, this deadline is also your deadline.

If you object to the destruction schedule proposed by a given agency, let NARA know! The more you can explain why the specific types of records should be kept longer (or should be kept permanently), the more impact you’ll have. Be sure to include the Record Schedule Number (or Disposition Authority Number) that you’re commenting on, preferably in the subject line of your email and in the body of your comment.
